“Project Management, Supervision of Design and Construction for the Northern Transnational Highway and the Network of Connecting Roads of the Connectivity Project”

This Specific Procurement Notice follows the General Procurement Notice (GPN) corresponding to the first semester 2008, published in dgMarket online on January 9, 2008, UN Development Business online on January 15, 2008 and in the local newspapers La Prensa Gráfica and El Diario de Hoy on January 18, 2008, and also posted on the FOMILENIO website at http://www.fomilenio.gob.sv

The Government of the Republic of El Salvador (GOES) received a US$ 460.9 million grant from the Government of the United States of America through the Millennium Challenge Corporation (MCC), a US Government corporation created to help to facilitate the reduction of poverty through economic growth. The Fondo del Milenio (FOMILENIO), the Millennium Challenge Account (MCA Entity), is the institution established under the laws of El Salvador to act in the name of the Government, and subject to the terms and conditions of related agreements, and the availability of funds, the GOES intends to use a portion of the proceeds indicated, to make eligible payments under the terms and conditions established on the contract resulting from the present Request for Proposal.

The payments to be done by FOMILENIO will be subjected to the terms and conditions, including restrictions on the use of funds from MCC indicated in the Compact. No other party that GOES and FOMILENIO will have any rights on the Compact or will have any rights to claim funds from the MCC resources.

The Consulting Firms will be selected under the Quality and Cost Based Selection (QCBS) described in the Request for Proposal (RFP), in accordance with the MCC Program Procurement Guidelines of February 15, 2008, Section 1.B, which is found at: http://www.mcc.gov/documents/mcc-guidelines-programprocurement.pdf. The Consulting Firms are advised that while these procedures are similar to those set out in the World Bank Guidelines there are several very significant differences. For that reason it is recommended that the Consulting Firms review carefully the documents of RFP and the pertaining sections of the MCC Procurement Guidelines.

Any person or entity that has been blacklisted from participation in procurements funded with the World Bank assistance or debarred or suspended from participation in procurements funded by the United States Federal Government or otherwise prohibited by applicable United States law or Executive Order or United States policies, including under any then-existing anti-terrorist policies, shall be excluded from this procurement.

The Connectivity Project included in the Compact has as main objective the reduction of transportation cost and time on the Northern Zone with the rest of the country and within the region. This project is divided in the following two activities: (i) “The Northern Transnational Highway - NTH” with a length of 290 km on 7 Sections, and; (ii) “The Network of Connecting Roads - NCR” with a length of 240 km on 3 Groups.

This invitation seeks technical and financial proposals from interested Consulting Firms to carry out the project management, design supervision and construction supervision related to the implementation of the Connectivity Project of the program as the Connectivity Project Manager –CPM. The RFP covers the whole project for the two activities indicated above.

The bidding for the CPM is structured in two packages, Package I for the NTH and Package II for the NCR. The Consulting Firms can present proposals for: (i) Package I; (ii) Package II; and (iii) a single proposal combining Packages I + II; or (iv) any combination of separate proposals thereof, such as one proposal for Package I, a second proposal for package II, and a third proposal for the combined Packages I and II. The Consulting Firms must present proposals for the whole package, covering all phases in that package as explained below. In case a firm presents a proposal for a fraction of a Package it shall be disqualified. The period of execution of the total services by the consulting services is about 50 months. The two Packages are described as follows:
Package I (NTH) is composed by 3 Phases:
• Phase 1: Project Management and Final Design Supervision of Sections 5, 6 and 7 (135 km)
• Phase 2: Project Management and Construction Supervision of Sections 2, 3 and 4 (128 km)
• Phase 3 (optional): Project Management and Construction Supervision of Sections 5, 6, 7 and possibly Section 1 (162 km)

Package II (NCR) is composed by 2 Phases:
• Phase 1: Project Management and Final Design Supervision for Groups 1, 2 and 3 (240 km)
• Phase 2 (optional): Project Management and Construction Supervision of Groups 1, 2 and 3 (240 km)

For the Financial Proposal, Consulting Firms are required to propose a Fixed-price contract under the form of Lump sum for the NTH and the NCR in separate contracts or for one contract combining both (see RFP and draft Contract for details). Payments will be based on specific deliverables from the selected Consulting Firms to meet the projects objectives in accordance with the TOR and deliverables established on the service contract with FOMILENIO. The services of this contract is estimated to start on August 2008.

Please note that a pre-proposal conference will be held on May 19, 2008 at 9:00 AM at FOMILENIO´s Procurement Agent Office – San Salvador, El Salvador – or other location to be indicated in San Salvador, El Salvador. The interested Consulting Firms can obtain the “Request for Proposals” documents without cost, and additional information in the address indicated below starting May 6, 2008 from Monday through Friday from 9:00 AM to 4:00 PM (El Salvador local time). The Request for Proposal documents can also be downloaded from FOMILENIO’s web page (www.fomilenio.gob.sv), in the Section Procurement, starting the above date.

The proposals must be submitted in Spanish, according to the MCC’s Spanish Language waiver dated March 13, 2008 in sealed and separated envelopes for the Technical and Financial proposals in one (1) original and three (3) copies, and one (1) electronic copy in the form of a CD Rom. The proposals shall be sent to the address indicated below by June 6, 2008, no later than 3:00 PM (El Salvador local time). Proposals received after this time and date shall not be considered and shall be returned unopened. Consulting Firms should be aware that distance and customs formalities may require longer than expected delivery time.
