COMPETITIVE BIDDING
No. FOM-CO-CB-70/2009

DESIGN/CONSTRUCTION OF SECTION 6 OF THE NORTHERN TRANSNATIONAL HIGHWAY; SEGMENT BETWEEN CIUDAD BARRIOS - OSICALA CROSSING AND DELICIAS DE CONCEPCION – CACAOPERA

This Competitive Bidding follows the General Procurement Notice corresponding to the second semester 2009, published in dgMarket online on July 1, 2009, UN Development Business online on July 1, 2009, local newspapers La Prensa Gráfica and El Diario de Hoy on June 29, 2009, and posted on the FOMILENIO website at http://www.fomilenio.gob.sv.

Through a grant agreement signed on November 29, 2006, the Government of El Salvador (GOES) received a US$ 460.9 million grant from the Government of the United States of America via the Millennium Challenge Corporation (MCC), a US Government corporation created to help to facilitate the reduction of poverty through sustainable economic growth. FOMILENIO (Fondo del Milenio), is the accountable institution established under Salvadoran law to act on behalf of GOES on this initiative. Subject to the terms and conditions of related agreements, and the availability of funds, GOES intends to use a portion of the proceeds of this Compact to fund procurement of DESIGN/CONSTRUCTION OF SECTION 6 OF THE NORTHERN TRANSNATIONAL HIGHWAY; SEGMENT BETWEEN CIUDAD BARRIOS - OSICALA CROSSING AND DELICIAS DE CONCEPCION - CACAOPERA in a transparent and fiscally sound manner.

The goal of the Compact is to advance economic growth and poverty reduction in the Northern Zone of El Salvador. The Program includes the following Projects: 1) Human Development Project, 2) Productive Development Project, and 3) Connectivity Project.

The payments to be done by FOMILENIO will be subjected to the terms and conditions, including restrictions on the use of funds from MCC indicated in the Compact. No other party but GOES and FOMILENIO will have any rights on the Compact or will have any rights to claim funds from the MCC resources.

Any person or entity that has been blacklisted from participation in procurements funded with World Bank assistance or debarred or suspended from participation in procurements funded by the United States Federal Government or otherwise prohibited by applicable United States law or Executive Order or United States policies, including under any then-existing anti-terrorist policies, shall be excluded from procurements awarded under the Compact.

The works and services to be contracted are on a fixed price basis.

A firm or JV will be selected under the method of Competitive Bidding (CB) described in the Bidding Documents, according with the MCC Program Procurement Guidelines of July 21 2008, Section 1.A, that are in:

The object of this procurement is to produce the final design and build the necessary works for the adequate functioning of approximately 30 Km of road. The project starts along the road that goes from Ciudad Barrios to Carolina, approximately 3 Km north of Ciudad Barrios and 3 Km South East of the end of Section 5, segment Nuevo Edén de San Juan - Carolina crossing. The project starts in Departamento of San Miguel, but most of it runs along Departamento of Morazan.

From the start, the project alignment runs North – East and passes San Antonio del Mosco crossing, the heads North up to San Simon. From here heads South and then East to pass by the entrance of Gualococti up to the entrance of Osicala, where is interrupted. After exiting Osicala the interruption continues over a distance of 3 Km on the Military road, from the 183.5 Km mark to the 180.5 Km mark, up to Delicias de Concepcion. Here is where the second part of the segment begins, heading South – East up to Cacaopera.

The first part of the project has approximately 23 Km, while the second one approximately 7 Km, for a total of approximately 30 Km. Approximately 40% of the project is on mountainous terrain (the majority in the first 10 Km). Another third of the project is on undulate terrain, and the rest is plain.

Please note that a visit to the site and a pre-bid conference will be held on November 5th and November 6th, 2009 respectively. The interested participants can obtain the “Bidding Documents” at no cost, and additional information in the address indicated below starting October 22, 2009 from Monday through Friday from 9:00 AM to 4:00 PM (El Salvador local time). The Bidding Documents can also be downloaded from FOMILENIO’s web page (www.fomilenio.gob.sv), in the Section Procurement, starting on the date indicated before.

Bids must be submitted in Spanish according to the renewed MCC’s Spanish Language waiver dated March 12th, 2009. The Bids have to be present and registered to the address indicated below by December 7th, 2009, no later than 10:00 AM (El Salvador local time). All Bids must be accompanied by a $400,000.00 Bid Security, in the form specified in the Bid Documents. Firms should be aware that distance and customs formalities may require longer than expected delivery time. Bids received after this time and date will not be considered and will be returned unopened.
